Ministry ने यह भी maintain किया कि existing marriage laws में 'spouse' term heterosexual marriages पर apply होती है, Supreme Court के 2023 same-sex marriage ruling के अनुसार. लेकिन existing legal और medical frameworks authorised representative को recognise कर सकते हैं, जो spouse या blood relative होना जरूरी नहीं.
Case दो questions को अलग करता है जिन्हें अक्सर एक माना जाता है: marriage recognition और chosen medical representative की recognition. High Court अब देखेगा कि existing law इस distinction पर कैसे apply होता है.
