Supreme Court ने कहा है कि वह तीन हफ्ते में Indian criminal law में marital-rape exception को challenge करने वाली petitions पर final hearing शुरू करेगा. अभी कोई final ruling नहीं आई है, इसलिए current development procedural है, लेकिन constitutional importance बहुत अधिक है.
Case के केंद्र में सवाल यह है कि क्या marriage non-consensual sex के criminal-law treatment को अलग बना सकती है. Petitioners equality, dignity, bodily autonomy और sexual consent पर जोर देते हैं, जबकि legislative caution की arguments criminal-law design, proof और Parliament की भूमिका जैसे मुद्दे उठाती हैं.
UPSC के लिए यह case Fundamental Rights, gender justice, judicial review और criminal-law reform के intersection पर है. Editorially सबसे सुरक्षित approach यही है कि Court के सामने मौजूद legal question को इस assumption से अलग रखा जाए कि Court अंततः क्या फैसला देगा.
